{"id":1749,"date":"2021-10-12T20:01:31","date_gmt":"2021-10-12T20:01:31","guid":{"rendered":"https:\/\/bgal.com.mx\/en\/?p=1749"},"modified":"2021-11-22T20:02:16","modified_gmt":"2021-11-22T20:02:16","slug":"nestle-loses-the-legal-battle-of-exclusive-rights","status":"publish","type":"post","link":"https:\/\/bgal.com.mx\/en\/?p=1749","title":{"rendered":"Nestl\u00e9 loses the legal battle of exclusive rights."},"content":{"rendered":"<p class=\"p1\">After serveral years of contentious procedures, Swiss justice finally decided not to grant protection, in terms ofthe National Trademark Law, to the popular shapeof Nespresso capsules manufactured by Nestl\u00e9.<\/p>\n<p class=\"p1\">It should be remembered that these capsules were invented by Eric Favre in the 70\u2019sand were protected until 1996, then Nestl\u00e9 tried to have them registered and valid indefinitely, in terms ofthe mentioned Law.<\/p>\n<p class=\"p1\">Although the multinational company obtained protection in 2000 for a period of ten years, once the stipulated time expired, the invention became part of the public domain, according to what was established by a Swiss civil court who annulled the registration.<\/p>\n<p class=\"p1\">In this context, the Ethical Coffee Company, launched biodegradable coffee capsules, very similar to the shape of Nespresso\u2019s capsules, which is why Nestl\u00e9 attacked its competitors with lawsuits for trademark infringement in Germany and Switzerland.<\/p>\n<p class=\"p1\">However, the Swiss court ruled that a shape cannot be registered as a trademark if it must necessarily be used by a competitor who wants to produce a similar product.
