Under the paradigm of trademark infringement and counterfeiting, as well as false advertising and unfair competition, Chanel initiated a trademark lawsuit in the High Court of the Commercial and Property Courts of England and Wales against Kensulate Corporation Limited, a company that operates as Crepslocker.

In the opinion of the French fashion house, the digital reseller violates the law by offering authentic products of the brand under conditions that damage its image, and also argues that for more than seven years, the defendant company has made unauthorized use of the name Chanel as trademark and double “C” logo in various forms.

In the complaint filed in September 2019, the fashion company assures that the shopping experience at Crepslocker deviated from the high quality standards offered to the customer. They also assert that the platform in question asks consumers to pay through Paypal and not with a credit card, which contravenes the return policies of items. Additionally, another of Chanel’s annoyances is that some of the bags sold by the British company, they do not have an authentication certificate.

It should be noted that the luxurious brand requires strict guidelines for the marketing of its items by third parties, however, the digital company by not complying with these standards is depriving Chanel’s ability to maintain the luxury, exclusivity and prestige associated with the products. Products that are an integral part of the brand and its promise and attraction to consumers and potential consumers.

For its part, Crepslocker defends its position of continuing to use its same sales system, until the Court rules on the matter, despite the losses and damages that it may cause to the French brand.

Finally, for the fashion mogul, the possible trademark infringement that the Court may establish against Crepslocker is not enough, since Chanel also seeks to be compensated for the monetary damages caused and to obtain custody of all articles or materials whose use or marketing contravenes the previous court order and that are within the possession, power, custody or control of Crepslocker.
